Significant Changes to the Solicitation

GSA has stated they will be releasing MAS Refresh 22 in August 2024.  Most notably, GSA has added multiple SINs to the Transactional Data Reporting (TDR) option that may be beneficial to your business.  The TDR Pilot program is looking to expand its presence by adding 67 SINs to its already popular program. By doing this, this will allow  more vendors who have not had the opportunity to enjoy the benefits of the TDR contract type. The SINs below are being added to the TDR program upon acceptance of the upcoming refresh to the MAS solicitation.

New SINS Eligible for TDR

Your company will want to participate in the TDR option because it relies on free market competition to drive prices down rather than government regulation and monitoring. Under the TDR program, vendors no longer must disclose their commercial sales practices (CSP) and the Price Reduction Clause is eliminated. The one major downside to joining TDR is that your company would be required to report all GSA sales transactions monthly and it requires more detailed reporting. In addition, there are also several changes to current SINs. The changes are mainly for SINs found under the Industrial Products/Services and  Transportation/Logistics MAS categories.

GSA MAS Refresh 22 changes to the Industrial Product SINs are as follows:

• • SIN 332510C: Point of Sale requirements will be removed from the SIN instructions.
  • SIN 332510S: Sustainable acquisition purchasing requirements of FAR 23 will be removed from the SIN instructions.
  • SIN 325320: Service Contract Act (FAR 22.10) and Davis-Bacon Act (FAR 22.404) applicability will be removed from the SIN instructions since these requirements apply to all MAS SINs. Similarly, the U.S. Environmental Protection Agency Comprehensive Procurement Guidelines (recycled content) program or the U.S. Department of Agriculture BioPreferred (biobased) program will be removed from the individual SIN requirements due to its applicability across all MAS SINs.

Transportation and Logistics Services changes are as follows:

• • SIN 492110: Add ‘Page Location’ and ‘Country of Origin’ columns to the required SIN templates.
  • SIN 485 and SIN 532111: Add ‘Page Location’ and ‘Country of Origin’ columns to the required SIN templates.
  • SIN 531 and SIN 531110: Add ‘Page Location’ and ‘Country of Origin’ columns to the required SIN templates.

Contractor’s Next Steps

Contractors have the opportunity to accept GSA Modification 22 by logging into the Mass Mod system. Once logged in, they will need to review the modification details and answer a series of questions related to the changes. It is important for contractors to thoroughly understand the consequences and new requirements associated with the updated terms and conditions before accepting and submitting the modification. As with any modification to a GSA contract, contractors should take the time to read through all the provided information, seek clarification if needed, and assess the impact on their operations before proceeding with acceptance.
